My Workers’ Compensation Benefits Were Denied. What’s Next?

Half of the battle in obtaining the medical treatment and financial assistance you need after an on-the-job injury involves illustrating the severity of your injury to your employers’ Workers’ Comp insurance carrier. Insufficient information often results in insufficient or denied settlements.

The first step to appealing an unfavorable decision involves communicating with your employer and the insurance carrier that has denied your benefits. With help from an experienced attorney you can request the claim be reviewed again with more information through administrative processes within the insurance company.

If this does not work, you will need to file a petition with the Office of Adjudication, which resolves disputes through the use of Workers’ Compensation (WC) judges in a hearing. Furthermore, if the WC judge’s decision is unfavorable, it can be appealed through the Workers’ Compensation Appeal Board and, if necessary, the Commonwealth Court.
